Terms of Service

PlanSafe is not an emergency service. In any real emergency in the United Kingdom, dial 999 (or 112). PlanSafe does not contact emergency services on your behalf and is not monitored in real time. Do not rely on it for life-safety decisions.

1. Who you are contracting with

You are contracting with:

Or, until incorporation, Jamie Wadhams trading as PlanSafe. "We", "us", and "our" mean that entity.

2. What PlanSafe is — and what it is not

PlanSafe is a personal emergency-preparedness planning tool. It helps you build and store a household emergency plan, list emergency contacts and dependants, and (where you opt in) receive location-based hazard alerts.

PlanSafe is not an emergency service. It does not contact emergency services on your behalf, does not guarantee delivery of any alert, and is not monitored in real time. In any real emergency in the UK, dial 999.

3. Eligibility

To use PlanSafe you must be at least 18 years old, resident in the United Kingdom, and have the legal capacity to enter into this contract. By creating an account you confirm all of the above.

4. Your account

You must give accurate sign-up information and keep it up to date. You are responsible for keeping your credentials confidential and for everything that happens under your account. Tell us immediately if you suspect unauthorised access. We may suspend or close an account used in breach of these Terms or where required by law.

5. Information you enter about other people

If you enter information about another person — a child, dependant, or emergency contact — you confirm that you have the authority to do so, and that you will, where age-appropriate, tell that person their data is in PlanSafe and that they can ask us to remove it. If a person asks us to remove their data, we will action it.

6. Acceptable use

You must not use PlanSafe for any unlawful purpose; enter information about someone without their permission (other than children in your care); harass, stalk, or threaten anyone; reverse-engineer, decompile, or scrape the app; resell or commercially exploit PlanSafe; upload unlawful or defamatory content; or make false or hoax emergency claims. We may suspend your account immediately for any material breach.

7. Subscriptions, billing and cancellation

7.1 How billing works

Subscriptions purchased through the iOS App Store are billed by Apple. Through Google Play, by Google. Otherwise, by Stripe on our behalf. We do not store your card details.

7.2 Auto-renewal

Subscriptions auto-renew at the end of each billing period at the then-current price unless you cancel beforehand. We will email you a reminder before any annual renewal price change.

7.3 Cancelling

You will keep access until the end of the period you have already paid for.

7.4 Cooling-off and refunds

Under the Consumer Contracts Regulations 2013 you have a 14-day cooling-off period from the day you start a subscription. By completing your purchase you consent to immediate access and acknowledge that you lose this right for content you have already used. App Store and Play Store refunds are handled by Apple and Google respectively. For Stripe purchases, contact us; we will refund where required by law.

Nothing here affects your statutory rights under the Consumer Rights Act 2015, including the right to a refund where digital content is faulty, not as described, or not fit for purpose.

7.5 Price changes

We will give you at least 30 days' written notice before any change to a recurring price you are paying. If you don't accept the change, cancel before it takes effect.

8. Our intellectual property

PlanSafe, its source code, content, branding, and design are owned by us or our licensors. We grant you a personal, revocable, non-exclusive, non-transferable licence to use the app on devices you own or control, solely for your personal, non-commercial use while these Terms are in force.

9. Your content

You keep ownership of any content you put into PlanSafe. You grant us a worldwide, royalty-free licence to host, copy, transmit, and display that content only as needed to operate the service for you. We do not use it for advertising, training AI models, or any other purpose, except in fully anonymised aggregate form as described in the Privacy Policy.

10. Third-party services

PlanSafe uses Apple, Google, Stripe, and a cloud hosting provider. Those companies have their own terms and privacy policies. If a third-party service becomes unavailable, parts of PlanSafe may stop working temporarily. We are not liable for those failures, but will work to restore service as quickly as we reasonably can.

11. Availability and changes

We aim to keep PlanSafe available 24/7 but cannot promise uninterrupted access. We will give reasonable notice of any change that materially reduces functionality you are paying for, and offer a pro-rated refund if you cancel as a result.

12. Our liability

Things we never limit

Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of your statutory rights under the Consumer Rights Act 2015; or anything else that cannot be limited by UK law.

Things we do limit

Subject to the above: we provide PlanSafe on an "as is" basis. We are not liable for any harm arising from reliance on PlanSafe in an emergency — it is a planning tool and does not replace 999. Our total liability to you in any 12-month period is limited to the greater of (a) subscription fees you have paid us in that period, or (b) £100. We are not liable for indirect or consequential losses, loss of profit, or loss of data caused by something outside our reasonable control.

13. Suspension and termination

You can stop using PlanSafe at any time via Settings Account Delete Account or by emailing us. We may suspend or close your account for breach, legal requirement, or discontinuation of the service. If we close your account other than for your breach, we will refund the unused portion of any prepaid subscription.

14. Changes to these Terms

If we make material changes (price, scope of service, your rights), we will email you at least 14 days before they take effect and require in-app acceptance. If you don't accept, you can close your account and receive a pro-rated refund of any prepaid period.

15. Governing law and jurisdiction

These Terms and any dispute arising from them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction — except that, if you are a UK consumer in Scotland or Northern Ireland, you may also bring proceedings in your home jurisdiction.

You also have the right to use the European Commission's Online Dispute Resolution platform and to escalate complaints to the Citizens Advice consumer helpline (0808 223 1133).
